4. The loss and damage suffered by stoppage of building operations for 12 months.
The subject matter of this dispute is a narrow strip of land between Marine Lot 184 and 185. This strip is, I believe, 2 feet 7 inches wide at the Southern end, and rises to a point not far from the Northern Boundaries of the Lot.
The facts and reasons are rather complicated, but I will endeavour to make them as plain as possible; and if referred to the plan, it will be seen that the question in dispute reduces itself to very small proportion.
The facts of the case were brought out in the suit of Chun Yak Chong Sophorn lately decided by the Supreme Court, they were very carefully considered by the Chief Justice in his decision, and it is to his judgment that I am indebted for many of the facts which will be mentioned in this Report. I know that the matter received from His Lordship both at the hearing and on Original hearing more than the ordinary amount of careful and minute consideration which he gives to his cases; and, as the facts formed by the judgment, there can be no doubt.
